الملخص

بدايةً لابد أن نبين انه ليس هناك تعريف محدود ولا نوع معين للذكاء الاصطناعي، وهي في طور التطوّر كل يوم، بل كل دقيقة، لجعل حياتنا أكثر أمانًا وسلامة، لكن لكل شيء ثمنّ، وثمن هذه الأشياء الذكية من شأنها أحداث مجموعة من الأخطاء والاضرار الناتجة عن العيوب أحيانًا، ولها مجموعة من الاثار القانونية المترتبة على ذلك، ولكي نستطيع أثبات عيب هذه المنتجات الذكية في حال وقع خطر ما لابد من أثبات الخطأ، والضرر، والعلاقة السببية بينهما، وقبلها لا بد من معرفة التنظيم القانوني لمسؤولية المتبوع عن أعمال تابعيه.. وذكر الفقه العراقي طرق بيان مسؤولية اثبات العيوب ودور القضاء في ذلك؛ ودور الخبير في حسم مواضع تلك النزاعات المتطورة في مجال التقدم الحاصل بالذكاء الصناعي.
