Abstract

Owing to the spread of thorny crisis of housing and the phenomenon of ownership for the apartments with the want to prolong the lives of real estate divided into floors and apartments in order to ensure a good management and a good utility. It is necessary to organize the Co-proprietorship of the real estate due to neglecting premises' facilities causing damages for many of them. Thus, the interests of the participants themselves were threatened by these co-parts because the owners of theses apartments are being indifferent and paying no attention such problem. Since the legislative rules stated in the civil law are insufficient and not suitable for the protection of these properties. So, the legislator must issue a legislation involves establishing a Union for both the real estate's owners and for the occupants, leaseholders, as well. This Union is to addresses the organization of the premises and to put a general approved strategy for preserving them, maintaining the ramshackle structures, regulating the relationship between the lessor and the lessee and for determining the duties of maintenance and restoration of such properties.
