Abstract

International judicial guarantees regulating the right to litigation are one of the international standards stipulated in international and regional instruments concerned with human rights, as they are a source of inspiration for national systems regulating the basic rights and freedoms of individuals, including the right to litigation, in their constitutions and internal laws, and obligating the States Parties to respect and protect the rights they stipulate, by By taking all legislative and non-legislative measures that it deems appropriate to regulate it and ensure the enjoyment of all individuals within its territory without discrimination between them.
